Terms and conditions of sale

Purpose

These general terms and conditions of sale (the Terms of Sale) apply to orders placed on this site or by WhatsApp with Maison Fakya, Casablanca, Morocco (phone and WhatsApp: +212 6 21 49 83 90; email: Maisonfakya@gmail.com). They are governed by Moroccan law, in particular Law No. 31-08 enacting consumer protection measures. By placing an order, you declare that you have read and accepted them.

Products

The products offered are foodstuffs (nuts, dried fruit, dates, spices and seeds) sold by weight. Photos and descriptions are as accurate as possible; slight variations in appearance, size or color may occur from one batch to another. The origin, the words “unsweetened” or “unsalted” and other characteristics are stated when they appear on the product label.

Prices

Prices are shown in Moroccan dirhams (MAD), all taxes included, for the weight displayed. They may change; the applicable price is the one displayed when the order is placed. Delivery is free in Casablanca.

Orders

You can order on the site, without creating an account, or on WhatsApp. Before placing your order, you can review and edit your cart. After you order, we contact you by phone or on WhatsApp to confirm the products, quantities, address and delivery time; the order is final once this confirmation is done. If a product is unavailable, we let you know and offer an equivalent product or the removal of the item; any amount already paid for an unavailable product is refunded to you within fifteen days at the latest (Law 31-08, Article 40).

Payment

Payment is made in cash or by card on delivery, or by bank transfer. For a transfer, our bank details are given to you right after you order and in the confirmation email. You then send us the transfer receipt on WhatsApp: the order is confirmed as soon as the receipt reaches us, then prepared, and it is delivered once payment is received. No bank card data is collected on the site.

Delivery

We deliver to the address provided, anywhere in Casablanca. The delivery time is agreed with you at confirmation. Unless otherwise agreed, the order is fulfilled within thirty days of its confirmation at the latest (Law 31-08, Article 39). Please check your order on receipt and tell us immediately about any missing or damaged product. The full conditions are on the Delivery and returns page.

Right of withdrawal

Under Article 36 of Law 31-08, you have seven days from receipt to exercise your right of withdrawal, without giving reasons or paying penalties, with return costs at your expense. Under Article 38, this right does not apply to goods likely to deteriorate or expire quickly, to goods made to your specifications (custom platters and assortments), or to goods that by their nature cannot be sent back, which is the case for opened or partly eaten foodstuffs. To exercise this right on an unopened product, in its original packaging, contact us on WhatsApp or by email. The refund is made within fifteen days of the exercise of this right at the latest (Article 37).

Legal warranty and complaints

Products are covered by the legal warranty against defects in the thing sold provided for by the Dahir forming the Code of Obligations and Contracts (Articles 549 to 575), applicable under Article 65 of Law 31-08. For any complaint, contact us on WhatsApp at +212 6 21 49 83 90 or by email at Maisonfakya@gmail.com, giving your order number and, if possible, a photo of the product.

Allergens

Our products contain tree nuts (almonds, cashews, pistachios, walnuts, pecans), peanuts and sesame, and some coatings may contain milk or gluten. As our products are stored and packed in the same place, cross-contamination is possible. People with allergies must consult us before placing any order.

Personal data

The information you give us is used to process and deliver your orders. How it is processed is described in our privacy policy, in accordance with Law No. 09-08.

Governing law and disputes

These Terms of Sale are governed by Moroccan law. In the event of a dispute, we invite you to contact us first to seek an amicable solution. Failing that, under Article 202 of Law 31-08, the competent court is, at your choice, that of your domicile or place of residence, or that of the place where the event that caused the harm occurred.
